اذا انعقد المجلس المجلس التاديبي بعد 44 يوما من الدعوة لانعقاده ، ورغم ان القانون لم يجعل جزاء لهذا، فهل يمكن رغم ذلك استغلال هذا التاخير في صالح الموظف؟

عدم احترام الادارة(المجلس التاديبي) للاجال المنصوص عليه في المادة 70 من قانون الوظيفة العمومية يجعل القرار الصادر عنها قابل للالغاء امام المحكمة الادارية الحكم عدد 7/2002/4 ت الصادر عن المحكمة الادارية بمكناس بتاريخ 28/02/2002 ملف عدد 01/02 بالغاء قرار وزير التربية الوطنية لخرقه الاجال المنصوص عليها في المادة 70 من قانون المدكور انشاء الله الامور في صالحك...لاتنسى 60 يوم من اجل الطعن
