شركة تجارية توجد في وضعية صعبة ثم اصدار حكم بفتح مسطرة التصفية القضائية في حقها ثم نشره بالجريدة الرسمية ... بعد مرور فترة تقدم أحد الدائنين في مواجهة الممثل القانوني للشركة بشكاية من أجل عدم توفير مؤونة شيك على اعتبار أنه يريد استخلاص دينه بواسطة الشيك مسحوب على الشركة . فهل يجوز اعتقال الممثل القانوني للشركة في هده النازلة ؟؟؟ وهل يشكل الحكم بفتح مسطرة التصفية القضائية ظرفا استثنائيا يخول للدائن فقط التسجيل في لائحة الدائنين التي يمسكها السنديك ؟ ... وما هي وجهة نظركم وشكرا
