السلام عليكم تزوج والدي من سيدة ، و قاموا بتبني طفل و ذلك بتسجيله في الحالة المدنية . و بعد 21 سنة من الزواج توفيت زوجة الاب. والدنا (نحن الابناء الشرعيين من الزوجة الاولى) اعترف لنا ان الطفل المسجل بالحالة المدنية ليس ابنه. و نحن نريد الطعن في ذلك النسب ( لان التبني حرام و ازالة الذنب على عاتق والدنا قبل فوات الاوان ) و دعوة الولد لوالديه الشرعيين. نريد ان نعرف الاجراءات القانونية و الادارية التي يجب اتباعها للطعن في هذا النسب.

إذا كان الأب لا زال حيا فهو الوحيد الذي يمكنه نفي النسب أما إذا كان قد توفي فلم يبق لكم حق في الطعن في النسب.
