نحن مجموعة من الاشخاص على الشياع قام طرف 1 برفع دعوع انهاء حالة الشياع وطرف 2 بمقال مضاد وطرف 3 قامو فقط بالدفاع حكمت المحكمة الابتدائية بقسمة عقار بقسمة عينية ولم ينصف الطرف 3 الحكم بسبب تجميع مجموعة من الورثة في نصيب واحد لا تربطهم . فاستأنفوا الحكم وحكم بتعديل الحكم من القسمة العينية الى قسمة تصفية. من له الحق في تبليغ و تنفيذ الحكم من الاطراف هل المستأنف وحده ام جميع الاطراف؟ سؤال أخر هل يمكن للأطراف التفاهم على عدم البيع بالمزاد والتنازل بعد الحكم ومن يؤدي المصاريف القضائية أذا امكن التراضي على قسمة رضائية عينية اذا كان الحكم بالصائر بالنسبة على جميع الاطراف . وشكرا على مساهمتكم في تنورينا للقانون
