السلام عليكم القرار الاستئنافي القاضي بالغاء الحكم الابتدائي فيما قضى به و الحكم من جديد برفض الطلب هل يمكن تنفيذه علما ان المستفيد من الحكم هو المدعى عليه اي المستانف و ليس المدعي اي المستانف عليه صاحب المقال الافتتاحي للدعوى مع العلم ان الطعن بالنقض لا يوقف تنفيد الاحكام الاستئنافية و شكرا
