السلام عليكم، سؤالي سيدي يتمحور حول اكتشافي لأرض فلاحية خارج المدار الحضري يستغلها أحد الرأسماليين وهي في ملكية معمر أجنبي اشتراها من جدي أيام الحماية. مع العلم أن هذا البيع تم بدون ترخيص من الدولة المغربية حسب بند الخزيرات لسنة 1906 والذي ينص على أن امتلاك الأجنبي للأرض يتم بموجب شراء و ترخيص و في حالة عدم وجود الترخيص فالبيع يكون باطلا. الأرض الأن لا زالت في اسم هذا المعمر ولم تسترجعها الدولة المغربية. هل يمكن لنا أن نسترجع هذه الأرض و كيف حيث أن البيع تم بدون ترخيص من الدولة المغربية؟
