هل محكمة النقض يمكن ان تخفض العقوبة

صدر حكم محكمة الاستئناف على والدي بالسجن لمدة 6 سنوات بعد ما كان الحكم السابق للمحكمة الابتدائية 5 سنوات بتهمة الحيازة والاتجار في المخدرات والتزوير الا انه تم رفع العقوبة الى 6 سنوات مع العلم انه لا علاقة له بالتزوير والاتجار لأنه سائق فقط الان سؤالي هو هل بامكاني الاستفادة من النقض؟ وهل لمحكمة النقض التخفيف من العقوبة ؟ وايضا هل اصحاب قضايا المخدرات يستفيدو من العفو ؟ و شكراا.

محكمة النقض هي محكمة قانون و ليست محكمة موضوع ، بمعنى أنها ليست درجة من درجات التقاضي فهي لا تخفض العقوبة و لا ترفعها و إنما ينحصر دورها في مراقبة مدى احترام محكمة ...
