ادا كان قاضي  التحقيق بمحكمة الاستئناف يتولى التحقيق في الجنايات وقاضي التحقيق بالمحكمة الابتدائية في الجنح.ففي النازلة التالية  _التزوير في محرر رسمي واستعماله ويتعلق الامر برسم استمرار فالمشهود له  المستفيد طبعا من الوثيقة سيخضع للتحقيق من طرف قاضي التحقيق بمحكمة الاستئناف.بالنسبة للشهود وهم متهمون طبقا للفصل355 من ق ج ( جنحة )وتم الاستماع اليهم ايضا من طرف الضابطة القضائية من سيتولى التحقيق معهم .
