هل يعتبر ارسال إنذار من اجل الأداء (إلى مكتري كراء شقة سكنية) عن طريق مفوض قضائي مباشرة وبدون اللجوء إلى محامي وبدون طلب من رئيس المحكمة ، هل يعتبر هذا الإنذار صحيحا ؟ ثانيا: ماهي الفصول القانونية التي يجب علي أن أضمها في هذا الإنذار لكي يعتبر صحيحا شكلا ؟ ثالثا: هل يجب أن اكتب في الانذار أنه سألتجء للمحكمة للمصادقة على الإنذار في حالة عدم الأداء في الأجل المحدد ؟ رابعا: بعد إرسال الإنذار من أجل الأداء ،ماهي الخطوة الثانية التي يتعين علي فعلها في حالة عدم الأداء في أجل 15 يوم ، هل يجب أن أرسل إنذار ثاني (إنذار أداء أو إفراغ مع تحديد أجل شهرين) أم المصادقة على الانذار مباشرة من طرف رئيس المحكمة ؟ شكرا لكم اساتدتي

يمكن لك الإدلاء بنسخة (فوطوكوبي) من العقد ولو لم يكن مسجلا لدى مصالح التسجيل، ما دام يحمل توقيعي الطرفين ومصادق عليه من لدن المصالح المختصة.

لكن هل ستسلمني المحكمة الحكم النهائي لأقوم بتنفيذه أم ستعترض وتطالبني بتسجيل العقد ؟

لا تستعجل الأمور، عليك بالقيام بالإجراءات اللازمة خطوة - خطوة، ولا داعي للقلق عن الإجراء النهائي، ما دام لم يحدث في أمره شيء.
