هل يمكن رفع دعوى الافراغ مباشرة بالمحكمة الاستاناف ؟

سلام عليكم هل يمكن رفع دعوى الافراغ للاحتلال مباشرة بالمحكمة الاستاناف لأن زوجي قد طلقني و بعدها قام بارجاعي يدون عقد زواج و انا لا اعلم و بعد مدة طالبته بعقد زواج و قام بكتابة التزام بالمقاطعة يلتزم فيه بأنني زوجته و قبل سنة علمت بأنه لم يرجعني بعقد زواج و الآن قام برفع دعوى الافراغ للاحتلال مباشرة في محكمة الاستئناف اي بدون أم يرفع هذه الدعوي في المحكمة الابتدائية مع العلم أنني أشك انه رفع هذه دعوى بناءا على حكم الطلاق و شكرا !
