هل يمكن لجماعة محلية صدر ضدها حكم بتسوية الوضعية الإدارية والمالية لمجموعة من الموظفين وتم تبليغها بذلك أن ترفض تنفيد تلك الأحكام بحجة أنها تنتظر حكم محكمة النقض ؟ وهل النسخة التنفيذية الأصلية التي يدلي بها الأمر بالصرف المحاسب العمومي حين تنفيد تلك الأحكام لا تسلم إلا للإدارة دون الأشخاص المعنيين بالحكم؟وكم هي المدة القانونية للتنفيد ؟

لا يمكنها ذلك لأن الطعن بالنقض لا يوقف التنفيذ إلا في الأحوال المنصوص عليها في الفصل 361 من قانون المسطرة المدنية.
