هذه قصتي منذ اربع سنوات اشتريت بعقد عرفي نصيب شخص في بقعة ارضية في ملكية سبعة ورثة (شياع) حسب شهادة الملكية العقارية..والبائع لي هو ابن احد الشركاء وذلك بوكالة عامة سمحت له بذلك .. سجلت ذلك في دار التسجيل وبعدا ذلك ذهبت الى المحافظة العقارية لادراج اسمي كمشتري على الشياع مكان البائع ..ورفضوا طلبي بدعوى ان الملف تنقصه الوكالة العامة الاصلية بدل الصورة المصادق عليها وملخص النضير العقاري..وحينئذ تفاجأت بمشاكل أخرى شخصية قاهرة جعلتني انسى واهمل قضية المحافضة وأخيرا وبعد هذه المدة قررت المتابعة واتصلت بالبائع وسلمني الوكالة الاصلية والنضير...واخبرني بموت والده .. سؤالي هو:هل موت والده له تأثير على العملية مع العلم ان كل الشركاء المذكورين في الملكية ميتون منذ اكثر من عشرين سنة للاشارة مساحة البقعة 720مترمربع نصيب البائع فيها مايعادل260مترمربع غير محددة ماهي الخطوات المتبعة في مثل هذه الحالة وماهي الصعوبات التي سأواجهها

إذن الأمر غير مفهوم هل يعلم الموظف أو المحافظة الغيب وبأن البائع توفي. يجب الاتصال بالمحافظ ومناقشة الأمر معه، لأن ما طلب منك يعني تقييد الورثة في الرسم العقاري

المهم ان تكون وكالة الوالد لولده الذي قام بالبيع منجزة قبل موتهن،والذي لا تأثير له عليها إذا كانت قبله. لا أرى صعوبة في تقييد الشراء بالمحافظة العقارية ما دمت قد استوفيت الشروط التي طلبها المحافظ ...
