حكمت المحكمة بالزيادة في مبلغ النفقة حيث صدر الحكم بتاريخ02/03/2015 الى انها قررت الزيادة ابتداء من 21/11/2014 اي تاريخ تسجيل الدعوى من طرف مطلقتي. 1 هل هناك خطأ ما أم أن الزيادة يبتدأ مفعولها قانونيا من تاريخ تسجيل الدعوى وليس تاريخ صدور الحكم. 2ماهو التاريخ المعتبر لاحتساب اجل السنة والتي بعد مرورها يحق لهاقانونيا رفع دعوى اخرى للمطالبة بالزيادة.

الأصل في النفقة أنه يحكم بها من تاريخ الامتناع، أما الزيادة فيها فمن تاريخ الطلب وبالتالي فلا وجود لأي خطأ ...
