هل لي الحق في فسخ العقد بعد تماطل المسير و عدم دفع واجب التسيير لمدة 7 أشهر و شكرا .

السلام أنا المالكة (ف ق ) للأصل التجاري فوضت لمسير (م ج) مقهى بعقد لمدة خمس سنوات و أمام شخص آخر يشهد و يعرف كل التفاصيل المبرمة في العقد إلا أن المسير بدأ التماطل في أداء الواجب الشهري لمدة 7 أشهر تحت دريعة أنه ليس له دخل كافي رغم أنه هو السبب في إهماله للمقهى بعدم تواجده مما أدى إلى نقص في المدخول و كذلك اعتماده على تقليص أجرة المستخدمين ك 200 درهم أسبوعيا للنادل و كذلك المسؤول عن ماكينة تحضير القهوة و بدون استخدام عاملة النظافة كما هو متداول و معروف لدى جميع المقاهي و نظرا و خوفا من ضياع و خسارة السمعة الطيبة للمقهى أطالب بفسخ العقد ... و شكرا
