عدم قبول الدعوى على صعيد محكمة الاستئناف

السلام عليكم ورحمة الله تعالى وبركاته : صدر حكم استئنافي في استحقاق عقار غير محفض كما يلي : إلغاء الحكم المستأنف و الحكم تصديا بعدم قبول الدعوى مع تحميل المستأنف عليهما الصائر . هل بامكان خاسر الدعوى هنا ان يعود الى المحكمة لتسجيل دعوى جديدة في نفس الموضوع والتي سبق له ان ربحها ابتدائيا وشكرا.

نعم يمكن إعادة الدعوى من جديد إذا كان الخلل في الدعوى الأولى شكليا أو لأنه لم يتم الإدلاء بوثيقة ما.
