جاء في المادة 62 من مدونة الشغل انه يتم الاستماع الى الاجير قبل فصله لارتكابه خطأ جسيم داخل 8 ايام من التاريخ الذي تبين فيه ارتكاب الخطأ هل التبين مقصود به تاريخ علم الادارة ام تاريخ ارتكاب الفعل مثلا اجير ارتكب خطأ مهنيا يوم 12/06/2017 وتم اعلام المشغل يوم 19/06/2017 هل العبرة بالتاريخ الاول ام الثاني.
