ما الدي يناقشه القضاء الجنائي في موضوع النزاع المؤثر في الملكية عل بمجرد نشوب نزاع في الملك تقضي المحكمة ببطلان رسم الملكية الدي ينجزه الحائز المستوفي لجميع شروط الحيازة القانونية بما فيها خلو العقار من النزاع طيلة المدة المكسبة للملك وستقوم تبعا لدلك بادانة الشهود رغم عدم علمهم بالمنازعة ام ستناقش هيئة الحكم او قاضي التحقيق متى نشب النزاع وبمادا نازع والحجج المتوفرة لدى المنازع....الخ كما يناقشها القضاء المدني.
