مدونة قانون الشغل والتعويض عن الطرد التعسفي

السلام عليكم جاء في أحد فصول مدونة الشغل أن التعويض عن الضرر يعادل أجرة شهر ونصف عن كل سنة عمل وأن كل جزء من السنة يحتسب سنة فهل مضي 16 يوما فقط من السنة الثانية كاف لتحقيق هذا الجزء وبالتالي اعتماده في الحساب كسنة ؟ علما أن الاجير يتقاضى أجرته يالشهر لا بالأيام أو الساعات ؟؟ ثانيا هل تاريخ الطرد التعسفي من العمل شفويا فقط مع توقف الاجير ومغادرته هو الدي سيحتسب عند المطالبة القضائية بالتعويضات ؟ أم أن المدة تسترسل مادام الاجير لم يتوصل بأي إعلام أو قرار كتابي يعلمه بالطرد بالرغم من تركه للعمل مجبرا لا مخيرا جراء الطرد التعسفي ؟؟
