هذا الاسبوع سيتم اصدار حكم بعد المداولة في قضية طلاق بالشقاق المرفوعة من طرف الزوج ديالي. من دون تقديم اي اسباب مقنعة للمحكمة. والدي اعتبرته طلب تعسفي. اريد ان اعرف هل من الممكن الروجوع الى الزوج بعد اصدار حكم الطلاق بالشقاق ام انه طلاق بائن؟

السلام ممكن ان يتنازل عن الدعوة قبل الحكم. و ممكن ارجاعك في فترة العدة

نعم بعدالعدة يكون طلاق باءن . يتوجب عليه الخطبة و صداق جديد . كاول مرة يتقدم للزواج. لماذا تنتظرين اصدار الحكم و مرور العدة . ارسلي لزوجك من يصلح بينكما و يتنازل علي الدعوة او ادا صدر الحكم ان يراجعك

شكرا على اجابتك. انا لا اريد الطلاق اصلا. لقد رفع دعوة الطلاق و ابننا بعمر شهرين. لحد الان لا اعرف الاسباب. لدرجة ان القاضي اعتبره طلب تعسغي من طرفه. مشاكل عائلية كاي اسرة مغربية فاختار التضحية بالاضعف. مع اننا لم نكن نعاني من مشاكل كبيرة قبل الانجاب.

الطلاق للشقاق فهو طلاق بائن بينونة صغرى ولا يمكن ارجاعك الى زوجك الا بعد انقضاء العدة ويتزوجك من جديد وما يترتب على ذالك من خطبة وصداق وعقد جديد

سلام عليكم.انا مستفيدة ومطلقة طلاق شقاق وانا في العدة الان،

سمعت ان طلاق الشقاق يكون بائن وليس رجعي اي انه ليس لديه الحق ان يرجع زوجته خلال فترة ...
