السلام عليكم. نحن بعض الورثة نريد المطالبة بقسمة شقة. حيث أن باقي الورثة رفضوا إجراء قسمة رضائية . كما أن شهادة الملكية مازالت بإسم المرحوم . هل يجب على جميع الورثة الذهاب إلى الوكالة العقارية لنقل الملكية إلى أسمائهم؟ مع العلم أنه من المستحيل أن يتفق جميع الورثة لفعل دلك . وهل يمكننا المطالبة بقسمة الشقة في المحكمة دون نقل الملكية ؟ وبعد دلك المطالبة بتعيين خبير لإعداد مشروع القسمة. جزاكم الله كل خير.
