سؤالي حول تسليم الملكية المشتركة للسانديك من طرف المقاول ورسوم السانديك

أقطن مند حوالي سنة تقريبا بمجموعة سكنية مكونة من 8 عمارات عمرها سنتين فقط. لدينا خلاف مع المقاول ويرفض مجلس الاتحاد تسلم الاقامة منه بسبب بعض الاختلالات الموجودة في الملكية المشتركة مثل التزفيت و المصاعد الغير آمنة وتشققات الجدران وغيرذلك من الاختلالات التي التزم معنا باصلاحها لكن دون الوفاء ذلك . لقد وضعنا شكاية لدى الجهات المختصة وسوف تخرج لجنة الشهر المقبل لمعاينة الاختلالات. المشكل أنه يقول أنه يريد التسليم بقوة القانون. هل هذا من حقه؟ وهل من حقه طلب قيمة 1200 درهم للسانديك لكل من اشترى شقة مع أنه لا يوجد سانديك حتى الآن؟
