لدي بعض الأسئلة في موضوع التحفيظ الجماعي: عقار مجموع مساحته 5000متر مربع تم قسمته على أربع متقاسمين على أساس بقعة لكل واحد.في إطار التحفيظ الجماعي مرت مرحلتأن ونحن الآن مقبلين على المرحلة الموالية المتعلقة بالبحث القانوني التي يتم فيها بالأدلاء بالوثائق. 1 أحد الشركاء رفض التحفيظ حيث ازال المعالم الموضوعة سلفا من طرف المكلفين بزاويا الملك الاربع وازاحها إلى مكان آخر. هل يمكن له رفض تحفيظ بقعته؟ ها ستحفظ البقع الاخرى اذا اصر على الرفض ؟هل من متابعة قانونية فيما قام به؟ 2 هل يمنع بيع أجزاء من البقعة إذا تم تحفيظها في إطار التحفيظ الجماعي بمعنى مساحة البقعة المحفظة 1100 متر مربع هل يمكن بيع 100 متر مربع مثلا دون صعوبات اقول هذا الكلام لأن الذي رفض التحفيظ لديه هذا التخوف.
