السلام عليكم اخواني اخواتي اسئلكم حول مآل التعويضات العائلية المتمثلة في المبلغ الدي تعطيه CNOPS لكل طفل مع العلم انني في طور اجراءات طلاق اتفاقي حددت مع طليقتي مبلغ النفقة و كل الامور لكن سمعت انه يمكنها بعد الطلاق ان تقدم طلبا بايقاف هذه التعويضات عني و استفادتها منها و بالتالي اصبح امنحها النفقة المتفق عليها و هي تستفيد من التعويضات العائلية ان كان جوابكم بنعم لها الحق في ذلك كيف لي ان اضمن عدم قيامها بذلك بعد الطلاق و لكم جزيل الشكر

طبقا للفصل الخامس من المرسوم الصادر بتاريخ 27-08-1957 والمعدل بمرسوم 2-01-1985 فإن التعويضات العائلية تصرف لمن له حضانة الأولاد بعد الطلاق.
