السلام عليكم قام مكري لمحل معد للاستعمال التجاري بواسطة عقد شفوي بإنذار المكتري لأداء متخلف خمس سنوات من الكراء تمهيدا لرفع دعوى المصادقة على الإنذار وطلب إفراغه للتماطل أولا ..ما قول المحكمة في رأيكم أمام إنكار المكتري لقيمة السومة الكرائية وإدعاء أنها أكثر مما اتفق عليه شفويا؟؟ ثانيا ,ماقولها لو أنكر المكتري وجود أي اتفاق على ألسومة الكرائية من الأصل وبالتالي ليس هناك من تماطل ( مع الإشارة لعدم وجود أي شهود أثناء الإتفاق الشفوي او أي إثبات في كلتا الحالتين ) ؟
