باع السيد نصيبه من قطعة أرض ورثها بعقد بيع ، لكن عندما أراد المشتري أن يقوم بعملية التحفيظ بلغه أن هنالك هبة في طور التنفيذ وبذلك يصبه نصيب البائع متغير عن النصيب موضوع البيع، وقطعة الارض موضوع نزاع وتعرض في المحكمة.
و على إثره لم يستطع البائع الحصول على المتبقى من مبلغ البيع، حصل كذلك أن توفي هذا البائع. هل يمكن للورثة إلغاء البيع .
