فائدة الادلاء بالاشهاد امام محكمة الموضوع

السلام عليكم الاستاد ايمن ادا ادلى الطاعن لتعزيز مقاله الافتتاحي باشهادين مصصحة الامضاء امام قضاة الموضوع بالمحكمة الاستئنافية يفيد شهوده بانهم يعرفون القطعة الارضية موضوع النزاع بين المستانف اي المطلوب و المستانف عليه اي الطاعن وان المستانف عليه اي الطاعن هو من يتصرف فيها ولم تجب المحكمة عن هدا الاشهاد واكتفت بالغاء الحكم الابتدائي فقط بجواب المطلوب بالحوز و التصرف وان شراء الطاعن مجرد من اصل الملك فهل يمكن اعتبارهدا سببا من اسباب النقض وشكرا لكم
