السلام عليكم ورحمة الله تعالى وبركاته وبعد, سبق لي ان ربحت دعوى استحقاق عقار غير محفظ على صعيد محكمة الاستئناف وقام خصمي باحالتها على محكمة النقض. سوالي هو : هل محكمة النقض تناقش الحجج المدلى بها ابتدائيا واستئنافيا ام تكتفي بالاطلاع عليها ومراقبة ا لاحكام والتاكد ما اذا كانت قرارات القضات مجانبة للصواب ام لا. وهل يستدعى الاطراف الى جلسات محكمة النقض , بخصوص المحامي هل من الضروري ان اوكله وشكرا.

للأخ سمير مرحبا أقول له إن الأمر لا يتعلق بجريمة وإنما بدعوى استحقاق.

صحيح أن محكمة النقض محكمة قانون ولكنها تبسط رقابتها ...
